Court and Agency Litigation

The Firm has had a long-standing illustrious litigation practice and its success rate in trial practice is excellent. The Firm's litigation team is composed of trial lawyers whose techniques are skillfully demonstrated and enhanced before trial and appellate courts, as well as administrative tribunals and bodies. Its trial lawyers specialize in developing and implementing complicated litigation.

The Firm's litigation practice primarily covers all aspects of:

  • commercial litigation, which includes inter-corporate disputes resulting from a breach of commercial contracts; partnership disputes; and intra-corporate disputes between corporations and their directors or shareholders;
  • civil litigation, which covers negligence and quasi-delict claims, product liability claims, and property disputes, among others;
  • administrative investigations and complaints instituted by and with regulatory bodies and other government agencies and departments, such as the Office of the Ombudsman and Department of Justice; and
  • criminal litigation, including preliminary investigations of criminal complaints.

In addition to the foregoing, the Firm is also capable of acting for clients in the following areas:

  • Election cases, including election protests;
  • Land registration cases; and
  • Congressional investigations.

The Firm also handled numerous cases involving complex civil law issues in contractual disputes, including: (a) acting as counsel for one of the biggest broadcasting companies in the Philippines in a case involving termination of a service contract for breach of the contractor; (b) representing one of the leading foreign manufacturers of motor vehicles in a suit involving its multi-million dollar dealership agreement with a domestic company; (c) representing one of the most prestigious commercial land developers in the country in a multi-million peso damage claim involving its property in Makati City; (d) representing one of the biggest foreign air carriers with worldwide operations in a multi-million peso damage claim; (e) acting as counsel for a concessionaire to enforce the terms of the Concession Agreement relating to entitlements under the agreement arising from force majeure events; (f) representing several leading banking institutions in enforcing their agreements with various parties; (g) representing one of the biggest land developers in the country in its suit for the right to participate in the development of multi-billion peso pieces of real property; (h) representing one of the biggest mining operators in Luzon in the enforcement of its operating agreement against the owner of the mining claims; (i) representing one of the leading prime property developers in the enforcement of its agreement with its joint venture partner; (j) representing one of the biggest telecommunications companies in Asia in a case involving enforcement of a shareholders agreement.
