Arbitration, Mediation, and Alternative Dispute Resolution

The Firm and its individual lawyers have extensive experience in litigation and international commercial arbitration, representing its clients in several dispute resolutions involving international and domestic arbitrations under UNCITRAL Rules, ICC Rules and Construction Arbitration under CIAC rules, including the following:

(a) Arbitration under UNCITRAL Rules

The Firm acted as Lead Counsel for the Claimant (Concessionaire) in an arbitration before an all-Filipino arbitration panel of three members, involving a minor dispute arising from a Concession Agreement, governed by Philippine law, for the delivery of water and sewerage services in the west service area in Metro Manila.

The Firm also acted as Co-Counsel for the Respondent in an international arbitration that has been adjudicated by an arbitration panel of three members whose chairman was appointed by the ICC.

(b) Arbitration under ICC Rules

The Firm acted as counsel for an international telecommunications company in a dispute arising from a shareholders agreement, governed by Philippine law.

The Firm’s attorneys were part of the Legal Team involved in the handling of claims by the Contractor in a Turnkey Engineering, Procurement and Construction Contract, governed by English Law, for the construction of a 1000 MW combined-cycle power plant in Batangas, whose claims were resolved in arbitration.

The Firm is also part of the Legal Team involved in handling a dispute arising from a Gas Sale and Purchase Agreement, governed by Philippine law, for the sale and purchase of natural gas produced from the Camago-Malampaya gas field.

The Firm also represented the Claimant in an arbitration held in Paris, France relating to a dispute involving the unpaid contractor’s fees of the Claimant.

(c) Construction Arbitration under CIAC Rules

The Firm represented the Claimant in a dispute with its contractors relating to the construction of a huge condominium project in Makati City which led to a settlement of the dispute.

The Firm also represented the Claimant in a dispute relating to the unpaid contractor’s fees of the Claimant resulting in a favorable award to the Claimant.
